Genesis Law Firm assists in obtaining lawful permanent U.S. residency (green cards). The ways of gaining lawful permanent residency are many, including family-based, work-based, and investment-based visa petitions. We at Genesis will evaluate your situation to help determine which methods might be best for you, your family, and anyone else you hope to bring to the United States.

One of the most common means of obtaining lawful permanent resident status is through I-130 family sponsorship. That is, U.S. citizens and lawful permanent U.S. residents can use Form I-130 to sponsor qualifying family members–children, spouses, parents, and brothers and sisters–for permanent U.S. residency.

Bringing a family member to the States can take quite a long time, but is largely dependent on the familial relationship involved. Establishing a qualifying familial relationship through Form I-130 can sometimes result in a relatively quick visa for your family member. This is because there are no numerical limits on certain family members, depending on the relationship to the U.S. citizen or permanent resident.

Form I-130’s definition of a qualifying family member depends partly upon the sponsor’s status in the United States. For example, married children can be qualifying family members of a U.S. citizen but not of a lawful permanent U.S. resident. Genesis can help you determine whether a given family member would qualify.

Genesis can also help determine whether an additional visa might be needed or advisable. Often, such as when the qualifying relative lives outside the U.S., it is necessary to seek an immigrant visa for him or her to enter the U.S. If you are engaged to a foreign fiancé(e) and s/he is currently in his/her home country, you may want to consider a K-1 fiancé(e) visa.

Other times, if the qualifying family member is in the United States already, an application to “adjust status” may be filed, in which case the qualifying relative may not need to leave the U.S. The immigration attorneys at Genesis Law Firm can help you decide which method best suits your particular situation.
